Rep. Louie Gohmert, R-Texas, told the “Todd Starnes Show” on Friday that it is imperative that the Department of Justice investigates the St. Louis prosecutor pursuing charges against the couple in the city that brandished guns a few weeks ago after protesters broke into their gated community.
“As long as the constitution is still valid, the Second Amendment is still there,” Gohmert said.
The incident that occurred outside the McCloskey home earlier this summer has been widely documented. Mark McCloskey, the homeowner, and his wife say they were threatened when hundreds of protesters swarmed their property. The protesters were en route to the city’s mayor’s home.
The two could be seen in viral videos holding guns and taking a defensive stance when engaging in verbal exchanges with the protesters. The mainstream media tried to paint the McCloskey’s as racists, but the narrative seemed to fall apart as more information emerged. For example, the McCloskeys said they called 911, but police never responded.
But that didn’t stop St. Louis Circuit Attorney Kim Gardner from condemning the couple, opening an investigation and stripping their guns, according to reports.

But the tables seem to be turning after the public and politicians came out in support of the couple’s right to defend their property.
Gohmert pointed to the Democrat-passed law from 1994, the Violent Crime Control and Law Enforcement Act, that calls for the government to investigate cases “involving a pattern or practice of conduct by law enforcement officers that violate our constitutional and federal rights.”
Gohmert said that Congress mentioned the law in a letter to Attorney Gen. William Barr, urging the country’s top prosecutor to launch a federal civil rights investigation into Gardner.
Sen. Josh Hawley, R- Mo., wrote to Barr that Gardner abused her power and “there is no question under Missouri law, that the McCloskeys had the right to own and use their firearms to protect themselves from threatened violence and that any criminal prosecution for these actions is legally unsound.”

Gohmert said the prosecutor didn’t go after the actual “assaulters” (the protesters). Instead, she decided to go after the victims in the case and used all her power to get them.
“That’s why we want a federal, Department of Justice investigation into Kim Gardner and anybody else who is assisting her in trying to prosecute the victims,” he said.
