Former Gov. Mike Huckabee warns Republicans to be careful with President Biden’s replacement for retiring Supreme Court Justice Stephen Breyer.
Biden promised to pick a black woman for the court ahead of the midterm elections as the GOP is hoping to regain control in Congress. Huckabee told the Todd Starnes Show Friday “bullying” them would bite them in the backside.
“The smart play here is to don’t give the Democrats a weapon for the midterm elections, which is exactly what we would be doing if we go all out nuclear on the nominee,” Huckabee told host Todd Starnes. “The big goal here is to win the 2022 elections — midterms — and then take the White House back in 2024. Don’t do something just to make a point that you’re not going to win anyway on the Supreme Court seat.”

“Now if it was a court flipper, if this was going to make it go 5-4 the other way, okay, then it’s worth a bigger fight,” he explained. “But this is one that is going to keep the Court just exactly where it is right now and you can call it a 6-3 or 5-4 (conservative majority) depending on which side of the bed Roberts gets up on each day, but be careful that you don’t use all your water for too small a fire.”
Huckabee acknowledged there are probably some Republicans that will not like what he said, but you have to pick your battles.

“I’ve been in this business 30 years,” said Huckabee. “You have to pick your fights and pick the ones that you can win and pick the ones that put you in a position where you can win the bigger fight later on, and that’s what we need to be winning is the big fight and that happens later.”
Huckabee does suggest Republicans give the nominee a rigorous hearing.
“Ask them tough questions about the Constitution and issues, but when it comes down to the vote, even after they’ve exposed them, don’t make it so that you do everything you can to try to stop the actual appointment unless it is so outrageous where a person is an avowed Marxist or something,” said Huckabee. “Even then, the Democrats have to carry that burden that gets nominated and affirmed all the way through these elections and there are going to be some Democrats or some nominees that Joe Biden might put forward that would be an albatross around the necks of people running for the Senate as a Democrat.”
Breyer was nominated by President Bill Clinton in 1994 and has been labeled a moderate by mainstream media. However, Newsbusters dismisses those claims, saying Breyer was a reliable vote against any pro-life legislation.
“On guns, he was in the minority on the historic 2008 Heller vs. D.C. decision establishing the Second Amendment as an individual right,” wrote Scott Whitlock for Newsbusters, a project of Media Research Center (MRC). “On economic issues, the Justice allowed eminent domain to go wild as the key fifth vote in 2005’s Kelo v. City of New London.”
