Middle School Student Punished for Misgendering a Classmate

The latest incident involves a 13-year-old boy at a Cincinnati-area middle school who was punished after he misgendered a male classmate who identifies as a girl.

Liberty Counsel attorney Richard Mast along with the sixth grader’s mother spoke out exclusively on The Todd Starnes Radio Show. We agreed to keep the identity of the children and the school private to protect the students.

The sixth grader and several classmates were having a conversation in an art class about a male student ho was talking about having his private parts removed so he would become a girl.

The sixth grader, who is from a Christian family, politely explained that’s not how biology works.  But instead of being given a good mark for having a basic understanding of human anatomy, the boy was sent to the principal’s office.

“He was really frustrated because he felt like he was being punished for doing the right thing,” the mother said on my radio show. “When he was brought into the principal’s office he understood from her that he would be required to refer to this boy as a girl going forward.”

She received a call from the school saying her son was being punished because he bullied a boy who identifies as a girl by calling him a boy.

“He was very upset when he came home because he felt like he was being punished for doing the right thing,” she said. “He didn’t do it out of a malice.”

Liberty Counsel attorney Richard Mast says the First Amendment protects the rights of students to speak the truth.
“We wanted to make sure that no students would be punished for expressing respectful disagreement on the subject of transgenderism,” Mast said. “And we wanted confirmation that no students will be punished or subjected to official coercion for using pronouns consistent with (the sex of students).”
